Debt Collections are generally handled in County Court, also known as Small Claims Court.  But do not let this fool you into thinking the process is an easy one, and can be handled without the assistance of an attorney. 

Both creditors and debtors must follow proper court procedure, as well as state and federal laws, when attempting to collect a debt or defending a collection lawsuit.

Debt collectors must be in compliance with the Fair Debt Collection Practices Act (FDCPA), which prohibits creditors from using abusive, unfair, or deceptive practices to collect a debt.  Debtors should be aware their failure to defend a collection case can lead to a judgment being entered against them, which ultimately may allow the creditor to garnish their wages or levy their property.
